Transition Salt Spring (TSS) says that addressing climate change and “restoring ecosystems” are central to their “core mission,” but do their policies support that claim? DRAFT TRUST POLICY STATEMENT TSS has expressed general support for the draft Trust Policy Statement, saying it “reflects genuine learning and real consultation.” They have suggested a number of changes and urged Trust Council to adopt an amended version without delay. Lawyer Don Lidstone, meanwhile, has shown how the document “prioritizes development” across numerous policy areas, especially the one dealing with housing, and “fails to address climate change in any meaningful way.” He called the lone policy on climate change “vague and nonspecific.” CLIMATE EMERGENCY In 2019, Trust Council declared a “climate emergency” and made a commitment “to pursue an absolute reduction in greenhouse gas emissions.” Yet today’s draft document does not mention that declaration, and makes no commitment to ach…

Draft Trust Policy Statement “Prioritizes Development” - Legal Opinion

By Frants Attorp If Trust Council adopts the draft Trust Policy Statement “in its current state,” it will not be “carrying out the object (mandate) of the Trust” as required by the Islands Trust Act, and that could trigger legal action. Specifically, the draft document, which would guide all island Official Community Plans, is “prioritizing development over protecting and preserving the unique amenities and environment of the Trust area.” So reads a February 17 letter sent to Trust Council by Don Lidstone KC, Senior Partner of Lidstone & Company. Widely regarded as western Canada’s leading specialist in local government law, Lidstone was also the Islands Trust’s lawyer earlier in his career. February 2 Last Day To Respond To Trust Survey

By Frants Attorp If you want a straight-forward answer you need to ask a straight-forward question. Why, then, has the Islands Trust produced a “Draft Policy Statement Survey” that only lawyers and policy analysts can fully understand? The survey, which closes on February 2, starts with a two-page preamble using specialized planning jargon. Next comes the draft itself with 18 pages of green assurances, most of which are vague and non-binding (although the public is unlikely to realize that). At the end of each section, respondents are invited to agree or disagree. I can only conclude that the authors lack knowledge about survey design or are deliberately trying to avoid discussion of major issues. Since they know exactly what’s being changed, why didn’t they include in the survey preamble a short list of the most significant changes to help the public provide more informed feedback? Affordable Housing Or Just More Development?

By Frants Attorp Trustee Laura Patrick’s recent Exchange article proclaiming her support for doughnut economics is belied by the evidence. Central to doughnut economics is a requirement to limit growth so it does not breach ecological boundaries. Yet, for the past several years, Trustee Patrick has worked to remove growth limits from our Official Community Plan (OCP) and the Trust Policy Statement (TPS)—despite scientific studies showing development at build-out is already unsustainable on several Gulf Islands. The requirement for trustees to respect local density limits has already been removed from the draft Trust Policy Statement which will guide all OCPs in the Trust Area. All that’s left now is to remove key growth-limiting policies at the island level, and that’s also underway. FAR – An Urban Strategy For The Gulf Islands

By Frants Attorp As the controversy over the rewrite of our Official Community Plan heats up, a very significant detail is being lost in the political rhetoric: a mathematical formula that could reshape Salt Spring and other Gulf Islands. It’s called floor area ratio, commonly known as FAR. FAR, which would allow for much higher densities, has now become a main driver of Salt Spring’s OCP “update.” Proponents see FAR as “a creative way” to provide more housing—even in the absence of housing agreements. Opponents, meanwhile, see FAR as an urban concept that risks destroying everything that makes the islands special, and are instead calling for affordable housing protected from the market forces that cause surging rents and costs. Right now a typical lot on Salt Spring is allowed one house no larger than 5000 sq feet (500 sq metres). Let’s Not Be Naive - Without Legal Limits on Development Anything Goes

Regardless of individual opinions on the future of Salt Spring, we should all consider this fact: When everything is discretionary, nothing is truly protected. There are only a few policies in our Official Community Plan that serve as unequivocal legal roadblocks to widespread development. Two of them, first identified by Islands Islands Trust lawyers in 2018, have to do with growth, and by extension, protection of the island’s resources, ecosystems and rural character. Together, these policies have the legal clout to prevent indiscriminate rezoning of private land. For example, they helped stop the recent Bylaw 530 which sought to upzone thousands of lots for extra dwellings—without any guarantee of affordability or long-term rental. But those policies are now threatened. A Flawed Process By Frants Attorp An open letter asking the Minister of Municipal Affairs to instruct the Salt Spring Local Trust Committee to withdraw the current “targeted” Official Community Plan – Land Use Bylaw (OCP-LUB) update project and instead undertake a full review if and when a new Trust Policy Statement is adopted: 1. TIMING MAKES NO SENSE – According to Trust planners, Salt Spring’s OCP must be “consistent with the Trust Policy Statement (TPS).” If so, it makes no sense to undertake a major OCP-LUB amendment project until after the new TPS is adopted. That’s the basic message Minister of Municipal Affairs Ravi Kahlon has sent to Trust Council, the political body of the Islands Trust, after its recent request that the Province conduct a full “review” of the Islands Trust Act—including the “preserve and protect” mandate which has restrained development on the Gulf Islands for the past 50 years. In an April 28th letter to Trust Council, which consists of all our 26 elected trustees, Minister Kahlon quashed any speculation that the Trust area, protected by the Islands Trust Act since 1974, can be governed much like any other part of the province. Population Matters – Limiting Growth on Salt Spring

After years of avoiding the issue, Salt Spring Solutions (SSS) has finally come down firmly against quantified growth restrictions in our Official Community Plan (OCP), calling them “antiquated theoretical calculations.” It is more evidence of their urban approach and relentless push for urban development. In response to my Exchange article called “Salt Spring’s Population Bomb,” they claimed my reference to the projected 17,000 build-out population “misrepresents the origin and meaning of the number,” and suggested the zoning cap in our OCP is not based on “an ecological assessment.” But the Ecosystem Health Report I cited, authored by Dr. David Rapport, an internationally-recognized ecologist and by Dr. Luisa Maffi, was commissioned by the Trust specifically for the 2008 OCP. Salt Spring’s Population Bomb

How many people can live on Salt Spring without ruining its distinctive natural features: 10,000, 50,000, or perhaps even one million? Technology knows no bounds, or does it? Many smaller islands around the world have populations that make the 12,000 on Salt Spring look very small. Consider Staten Island at 500,000 or Manhattan at 1.6 million. But neither of those islands is part of an internationally-recognized protected area with “unique and special marine and wildlife habitats”—and both pipe water from distant watersheds. When our existing Official Community Plan (OCP) was developed in 2008, protection of the natural environment was deemed the top priority as per the Islands Trust Act. Wish List Planning - Salt Spring's Official Community Plan

Salt Spring is about to embark on a “targeted update” of its Official Community Plan, and the proposed changes are far from modest—they could transform the island in ways few would have imagined possible, and spell the end of the Islands Trust in all but name. This coming Wednesday and Friday, the Islands Trust is inviting island residents to give their opinion on “what makes a complete community.” It sounds like a trip to the promised land, but be careful what you wish for! The “complete communities” assessment covers topics such as housing, transportation, employment opportunities, services and amenities. But there is a problem: the process, especially for housing, is starting with a wish list rather than a community discussion of growth parameters which are essential in a protected area. Cedars of Tuam Well runs low... again

The Cedars of Tuam community water system, which services 17 households along Roland Road at the South End, is once again in serious trouble due to drought. And the CRD, which took over operation of the system in 2005, is struggling to sort things out. Water was delivered to top up the reservoir last Friday, October 20 after the water level in the single well ran low and matters were complicated by long-standing issues with sand and grit. It seems that recent rains, at least prior to this week’s downpour, have done little to recharge the aquifer that feeds the well. CRD Director Gary Holman believes climate change is playing a role: “The well has always been marginal,” he said, “but the situation has been exacerbated by climate change.” He added that “it’s part of a broader drying trend in the region,” and that numerous private wells on the island have also been impacted. Opinion: Bylaw 530 – Going for Growth

Proposed Bylaw 530 will affect vast numbers of lots on Salt Spring. We don’t yet know exactly how many because the 5215 figure provided by the Islands Trust apparently needs some adjustment. But we do know that, if the zoning changes proceed as discussed, thousands of additional lots will be allowed to have an Accessory Dwelling Unit - either a secondary suite or detached dwelling. Adding so many potential new densities to the island is a gross violation of our Official Community Plan. Policy B.2.1.2.1 of our OCP states: “Zoning changes should be avoided if they would likely result in a larger island population than is expected under the development potential zoned in 2008. Exceptions to this policy are to be few and minor and only to achieve affordable housing and other objectives of this Plan.” The word “population” signals that the most significant environmental impacts come not from the number of lots, but from the number of people. Opinion: Bill 43 not suited for the Gulf Islands

The provincial government’s Bill 43, also known as The Housing Supply Act, will require communities to meet provincial housing targets and allow more dwellings to be built on new and existing lots. It is intended for municipalities where there are full services, not rural areas where most homes are on septic and well, and definitely not for islands that are protected by special legislation for future generations. But that hasn’t stopped Trustee Laura Patrick from lobbying MLA Adam Olsen and others to have the Trust Area included under the Act—even before the regulations are finalized. She doesn’t seem to understand that, without the proper infrastructure, urban solutions become tools of rural destruction. Is Bylaw 530 illegal?

As almost everyone on Salt Spring is now aware, major changes regarding land use are afoot. What they may not realize is that due process has been abandoned. The most recent land-use controversy involves proposed Bylaw 530 which seeks to rezone thousands of lots to allow for year-round suites and cottages (Accessory Dwelling Units). We do not know exactly how many lots are involved because the Islands Trust has yet to release that information, but we do know the bylaw will blanket rezone most of the island. By any measure, the bylaw represents a major change that will determine how the island looks in the future. This raises a question of legality. Where is the amendment to our Official Community Plan (OCP) that must accompany such a radical change--the extra paperwork that would force a discussion about, not just short-term objectives, but long-term consequences? Opposition to the proposed Vortex resort at the site of the former Fulford Inn has grown from a rumble to a roar as the public becomes more informed about the details of the project. Most recently, BC Nature, a highly respected and influential group representing 6,000 naturalists throughout British Columbia, came out firmly against the project. An official letter to the Trust has called for the estuary to be restored to its natural state: “BC Nature, a federation of more than 50 naturalists’ clubs with 6,000 members throughout BC, believes that the natural health and wealth of B.C. is essential to a sustainable future. One year and $75,000 after commissioning an independent review of its own performance, the Islands Trust, the governing body charged with “preserving and protecting” the Gulf Islands, has received a devastating report card. The bad news is summed up on the first page: “Current Trust Council practices do not meet the requirements set by good governance principles.” Created by special legislation in 1974 in response to “unprecedented pressure for residential development”, the Islands Trust received passing grades in only four of thirteen subcategories. Fulford Vortex Proposal In Focus

With regard to the proposed Vortex development at the site of the former Fulford Inn (17 commercial guest accommodation units, a restaurant, and associated facilities), the public should be aware that the Local Trust Committee, in granting a variance to decrease septic setback distances from Soule Creek and Fulford Harbour, did not heed the recommendation of Trust staff. The staff report states: “Staff do not support this variance request and consider it to be contrary to Land Use Bylaw and OCP provisions for water quality protection.” Here is the rationale: “Adjacent to a fish-bearing stream. Adjacent to a sensitive estuarine ecosystem. Projected to be subject to climate change-induced flooding. Presence of recorded archaeological site.” Trust bylaw regulations require a minimum setback of 30 metres – a safety margin based on scientific research. Water Licence Approved for Park Drive Development Project

A conditional groundwater licence (file 20006356/search number 500810) has been approved for a major housing complex on Park Drive near downtown Ganges. The licence, issued by the Ministry of Forests, Lands, Natural Resource Operations and Rural Development, allows for the diversion of a maximum of 19 cubic metres of water per day. The groundwater diversion relates to a rezoning application currently before the Islands Trust. The proposal, by Eric Booth representing Salt Spring Ventures Inc., involves amenity zoning, meaning that there is a request for higher densities in exchange for a benefit to the community. A 3.28 acre parcel on Park Drive, which contains Swanson's Pond, was rezoned in the late 1980s allowing for 33 dwelling units. In 2013, the applicant submitted a rezoning application seeking 83 densities on the property.
